1. Acceptance of Terms

By accessing or using the website durotop.in (the “Website”), or by requesting a quote, placing an order or using any service offered by Durotop Construction Chemicals (“Durotop”, “we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Website.

2. About Durotop

Durotop supplies construction chemicals and related products and provides product information and technical guidance for construction, waterproofing, repair and allied applications. We are based in Udupi, Karnataka, India.

3. Use of the Website

You agree to use the Website only for lawful purposes. You must not:

  • Misuse the Website, attempt unauthorized access, or interfere with its operation or security.
  • Submit false, misleading or fraudulent information in enquiry forms, quotes or orders.
  • Copy, scrape, reproduce or distribute our content, images, logos or product information without written permission.
  • Use the Website to transmit malware, spam or any harmful or unlawful material.

4. Products and Information

  • Product descriptions, images, specifications, coverage rates and technical data on the Website are provided for general guidance. Colours, packaging and specifications may vary slightly.
  • Actual performance depends on site conditions, substrate quality, surface preparation, mixing, weather, workmanship and application method. We do not guarantee identical results in every situation.
  • Please always read the product’s Technical Data Sheet (TDS), Safety Data Sheet (SDS) and application instructions before use. We recommend a trial or patch test before full-scale application.
  • We may modify, improve or discontinue products and update information without prior notice.

5. Enquiries, Quotations and Orders

  • Submitting an enquiry or requesting a quote does not create a binding contract. An order is confirmed only when we accept it in writing (including by email or message) or dispatch the goods.
  • Quotations are valid for the period stated in the quote. If no period is stated, they are valid for 7 days.
  • We reserve the right to decline or cancel any order, including due to stock unavailability, pricing errors or inability to deliver to your location.

6. Pricing and Payment

  • All prices are in Indian Rupees (INR) unless stated otherwise.
  • Prices are exclusive of GST and other applicable taxes unless stated otherwise.
  • Prices may change without notice. The price confirmed in your accepted order or invoice will apply.
  • Payment terms (advance, credit or otherwise) will be as agreed in the quotation or invoice. Delayed payments may attract interest or suspension of further supply.

7. Delivery and Shipping

  • Delivery timelines are estimates and not guaranteed. We are not liable for delays caused by transport providers, weather, strikes or other events beyond our control.
  • Delivery charges, if any, will be mentioned in the quotation or invoice.
  • Risk in the goods passes to you upon delivery. Please inspect goods at the time of delivery and report visible damage or shortage within 48 hours.

8. Returns, Replacements and Refunds

  • Because of the nature of chemical products, opened, used, mixed or tampered products cannot be returned.
  • Unopened, sealed products in original packaging may be considered for return or exchange only if reported within [7] days of delivery and approved by us. Return freight may be borne by the customer unless the error is ours.
  • If you receive a wrong or damaged product, notify us with photos within 48 hours of delivery, and we will arrange a replacement or resolution.
  • Approved refunds will be processed to the original mode of payment within a reasonable time.

9. Warranty and Disclaimer

  • We warrant that our products conform to their stated specifications when stored and used as directed.
  • We are not responsible for failures arising from incorrect storage, improper surface preparation, wrong mixing or application, use of the product for an unintended purpose, structural defects, or use of third-party materials.
  • Except as expressly stated, the Website and its content are provided “as is” and “as available”, and all other warranties, to the extent permitted by law, are disclaimed.

10. Safe Handling

Construction chemicals may be hazardous if mishandled. You are responsible for following the SDS, using appropriate protective equipment, keeping products away from children, and storing and disposing of them lawfully and safely.

11. Limitation of Liability

To the maximum extent permitted by law, Durotop shall not be liable for any indirect, incidental, special or consequential loss, including loss of profit, business, or project delays, arising from the use of the Website or products. Our total liability for any claim shall not exceed the amount you paid for the specific product or service giving rise to the claim.

12. Intellectual Property

All content on the Website, including the Durotop name, logo, text, graphics, images and design, is owned by or licensed to Durotop and protected under applicable intellectual property laws. You may not use it without our prior written consent.

13. Third-Party Links

The Website may contain links to third-party websites. We do not control or endorse them and are not responsible for their content or practices.
